Public offer agreement

This document is an official proposal (public offer) of the individual entrepreneur Ivashchenko Alla Volodymyrivna, hereinafter referred to as the Seller, to conclude a contract for the purchase and sale of goods remotely with any individual or legal entity, hereinafter referred to as the Buyer, who has accepted the terms of this offer.

1. General provisions

1.1. This contract is concluded by acceptance (acceptance) by the Buyer of the terms of the public offer and is an accession contract in accordance with Article 634 of the Civil Code of Ukraine.

1.2. Acceptance of the offer is considered to be the Buyer's performance of any of the following actions: placing an order on the website, confirming the order by phone or in correspondence, making payment for the goods.

1.3. The Seller reserves the right to change the terms of the offer without prior notice. The new version comes into force from the moment of its publication on the website. Orders placed before the change in the terms and conditions are executed under the terms and conditions that were in effect at the time of their placement.

1.4. The Seller sells numismatic products, investment coins, banknotes and related accessories through the online store at: coinshop.com.ua.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer the goods specified in the order to the Buyer, and the Buyer undertakes to accept and pay for these goods under the terms and conditions of this Agreement.

2.2. The name, quantity, characteristics and price of the goods are determined by the Buyer's order, confirmed by the Seller.

2.3. The right of ownership of the goods passes to the Buyer from the moment of actual transfer of the goods and full payment for them.

2.3. All goods placed on the site, except for NBU coins, are distributed as souvenirs and are not means of payment.

3. Price and payment procedure

3.1. The price of goods is indicated on the site in hryvnias (UAH) and includes all taxes and fees stipulated by the legislation of Ukraine.

3.2. Prices for investment coins (gold, silver bullion) may change in accordance with fluctuations in precious metal quotations. The current price is fixed at the time of order confirmation by the Seller.

3.3. Payment is made by one of the methods specified in the "Payment and Delivery" section on the store's website: by bank card online, by bank transfer.

3.4. The order is considered confirmed after receipt of payment.

3.5. In case of impossibility of fulfilling the order (lack of goods in stock, error in the price), the Seller notifies the Buyer and returns the paid funds in full within 3 business days.

4. Delivery

4.1. Delivery of goods is carried out by the delivery services indicated on the website (Nova Poshta, Ukrposhta).

4.2. Delivery times are approximate and depend on the delivery service and the Buyer's location.

4.3. The risk of accidental loss or damage to the goods passes to the Buyer from the moment the goods are transferred to the delivery service.

4.4. The Seller declares the value of the shipment in accordance with the real value of the goods. In case of loss or damage during delivery, claims are submitted to the delivery service.

4.5. Upon receipt of the parcel, the Buyer is obliged to check the integrity of the packaging in the presence of a representative of the delivery service. If damage is detected, draw up an appropriate report.

5. Rights and obligations of the parties

5.1. The Seller undertakes:

  • to transfer to the Buyer the goods of proper quality, corresponding to the description on the website;
  • to ensure safe packaging of the goods for transportation;
  • to provide reliable information about the characteristics and condition of the goods;
  • to fulfill the order within the specified time limits or notify the Buyer of the impossibility of fulfillment;
  • to maintain the confidentiality of the Buyer's personal data in accordance with the Law of Ukraine "On the Protection of Personal Data".

5.2. The Seller has the right:

  • to refuse to fulfill the order in case of detection of signs of fraud or violation of the terms of the contract by the Buyer;
  • to change the prices of the goods;
  • to make changes to the terms of the offer.

5.3. The Buyer undertakes to:

  • provide reliable contact details and delivery address;
  • pay for the order in a timely manner;
  • receive the goods at the carrier's office within the established storage periods;
  • upon receipt, check the conformity of the goods with the order and the integrity of the packaging.

5.4. The Buyer has the right:

  • receive complete information about the goods before making a purchase;
  • return the goods in cases provided for in Section 6 of this Agreement;
  • apply to the Seller with a claim in the event of receiving goods of inadequate quality.

6. Return and exchange of goods

6.1. The Buyer has the right to return the goods or demand their exchange within 14 calendar days from the date of receipt in the following cases:

  • the goods have a hidden defect not specified in the description;
  • the goods were damaged during delivery (if there is a certificate from the delivery service).

6.2. The refund is made within 7 business days after the Seller receives the returned goods and confirms the validity of the claim.

6.3. The goods are not subject to return if:

  • the coin was removed from the original capsule or packaging after receipt (if the removal was not necessary to detect the defect);
  • the goods were used or damaged due to the fault of the Buyer;
  • 14 calendar days have passed since the date of receipt.

6.4. To initiate a return, the Buyer sends a message to order@сoinshop.com.ua describing the reason for the return, photos of the product, and the order number.

6.5. The Seller pays the return shipping costs if the return is due to an error or defect caused by the Seller. In other cases, the Buyer pays.

7. Quality guarantees

7.1. The Seller guarantees the authenticity of each product sold through the store. The products are checked before shipment.

7.2. The condition of the coins corresponds to the description specified on the product page and is assessed according to the international numismatic scale (Poor, Good, Fine, VF, XF, UNC, BU, Proof).

7.3. NBU coins are supplied with original certificates of the National Bank of Ukraine (if the certificate is specified in the description).

8. Personal data

8.1. By placing an order, the Buyer consents to the processing of his personal data (name, address, telephone number, email) solely for the purpose of fulfilling the order and communicating with the Buyer.

8.2. The Seller does not transfer personal data to third parties, with the exception of delivery services - to the extent necessary for delivery.

8.3. Personal data is processed in accordance with the Law of Ukraine "On Personal Data Protection" dated 01.06.2010 No. 2297-VI.

9. Liability of the parties

9.1. For failure to fulfill or improper fulfillment of the terms of this agreement, the parties shall be liable in accordance with the current legislation of Ukraine.

9.2. The Seller is not responsible for any delay or failure to fulfill obligations arising from force majeure circumstances: acts of war, state of emergency, natural disasters, disruptions in the work of postal services and other circumstances beyond the reasonable control of the Seller.

9.3. The Seller is not responsible for the actions of delivery services after the goods are transferred to them.

10. Dispute resolution

10.1. All disputes arising between the parties are resolved through negotiations. The Buyer sends a claim to order@сoinshop.com.ua, the Seller considers it within 10 business days.

10.2. In case of failure to resolve the dispute through negotiations, it shall be resolved in court in accordance with the legislation of Ukraine.
